1. Acceptance of Terms
By accessing, browsing, or undertaking an assessment on the Trio English Proficiency Assessment Platform ("Trio", "we", "our", or "the Platform"), you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service.
If you are taking an assessment at the direction of an employer, university, or recruitment partner ("Evaluating Organization"), your test results and integrity metrics will be delivered to that organization in accordance with these Terms.
2. Platform Description & Service Access
Trio provides an automated, multimodal assessment service that evaluates English language competencies including speech tempo, phoneme accuracy, listening comprehension, grammatical syntax, and lexical resource aligned with the Common European Framework of Reference for Languages (CEFR).
3. Candidate Requirements & Technical Readiness
Candidates must fulfill the following criteria to ensure valid evaluation:
- Functional Microphone: A working microphone capable of capturing clear audio without severe static or distortion.
- Modern Web Browser: An updated version of Google Chrome, Microsoft Edge, Safari, or Firefox with audio and JavaScript permissions enabled.
- Quiet Environment: An isolated testing area free from loud background noise, music, or other individuals speaking.
4. Anti-Cheat Policy & Code of Academic Integrity
Strict integrity standards are enforced throughout the examination. The following behaviors constitute serious violations and may lead to automatic disqualification:
- Third-Party Assistance: Receiving prompting, whispered cues, or translation assistance from another person during active questions.
- AI & Machine Translation Injections: Utilizing external speech synthesizers, AI transcription overlays, or automated translation tools.
- Tab Switching & Window Inactivity: Navigating away from the active assessment browser tab during timed sections.
- Audio Scrubbing / Recording Manipulation: Attempting to tamper with audio player streams or inject pre-recorded audio waveforms into the microphone stream.
5. AI Scoring Calibration & Accuracy
Trio uses advanced neural acoustic and natural language processing models calibrated against extensive CEFR speech corpora.
- Scores reflect automated evaluation of acoustic speech clarity, lexical richness, and grammatical accuracy at the time of testing.
- Scores are provided on an objective numerical scale (0–100) and mapped to standard CEFR bands (A1, A2, B1, B2, C1, C2).
- Final hiring, admission, or certification decisions remain the sole responsibility of the Evaluating Organization.
6. Intellectual Property & Assessment Material
All assessment prompts, audio recordings, dialogue scripts, scoring heuristics, and software code are the exclusive intellectual property of Trio and its licensors. Candidates and administrators are strictly prohibited from copying, distributing, screenshotting, or publicly disclosing exam questions.
7. Enterprise Customer Terms
Enterprise administrators and recruiters using the Admin Portal agree to:
- Maintain the confidentiality of admin login credentials and candidate personal data.
- Use candidate assessment results solely for legitimate employment or academic evaluation purposes.
- Comply with applicable employment non-discrimination laws and data protection regulations.
8. Limitation of Liability & Disclaimers
The platform is provided "as is" and "as available". While we strive for high platform availability, we do not warrant that uninterrupted internet connections or candidate-side hardware failures will not impact an exam session. In the event of an unavoidable technical failure, candidates may request a test reset through their evaluating recruiter.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with standard international commercial arbitration principles and the applicable jurisdiction of the service provider.
